Our Guiding Principles
Occupational Safety and Health Act 1994
Employers have a general duty to ensure the safety, health, and welfare of their employees. This includes providing a safe workplace, safe systems of work, training and supervision.
OSHA Amendment effective 1 June 2024
All sectors including private, government-linked, and statutory bodies (excluding domestic services, armed forces & Work on Board Ships) must abide by OSHA 1994 Regulations.
Key Responsibilities for Employers as required by OSHA:
- Establish a Safety and Health Committee (mandatory for ≥5 workers under new amendment).
- Conduct risk assessments and implement control measures.
- Ensure training, supervision, and provision of PPE.
- Notify and report workplace accidents and occupational diseases.
- Appoint a competent person or Safety and Health Officer (based on risk/size).
Breach of the duty to ensure employees’ safety, health and welfare at work or to establish a safety and health policies has increased penalties from RM50,000 to RM500,000.
Company officers—including directors, managers, partners, secretaries, or anyone involved in managing or assisting in the company’s affairs—can be held jointly and severally liable for any offences committed by the company.
